II.    CALL TO ORDER   The President called the meeting to order at 2:50 p.m.

VI.   REPORTS

A.  President:

Contract Change: With the changes in the evaluation process for associate faculty each Council rep will be assigned a department to review the changes and insure that the evaluation process is followed.

Distance Learning Evaluation Form: we have a form for this but there is no process for administering the form. HR, the Deans of Instruction from both campuses, and an ACE rep (S. Pancella) are working together to come up with a process. The plan is to do a pilot test on this process this semester on each campus, make any necessary adjustments, and then use the process in all distance learning classes in the spring semester. Randy asked if this process will have to go through contract administration before it is placed into the contract.

Requests to HR: we the addition of PGD steps we have made a request to extend the date for submission of the PGD form for those faculty who may now be eligible to do PGD because of the new steps. We are waiting for a response from James Andrews.

50% Lawsuit: The case was not dismissed. On merit it was dismissed because the judge said that we had no standing to sue. The judge did not even look at the merits of the case. The judge said that we had no standing to sue and that the only one who could sue was the State Chancellor's office. Our attorney is presenting the amended lawsuit with supporting case law as to why we can sue.

C.  Secretary:  A summary of the tentative agreement will be sent to all faculty members after this meeting. The ballots will be mailed over the weekend. The deadline date for the ballots is Thursday, October 26 at noon. Details on where and when we will count the ballots will be sent to the Council as we get closer to this date.

E.  Budget Analyst: None

F.   Newsletter Editor:  None

Tentative Agreement: The negotiating team presented the tentative agreement and answered questions.

Motion: To accept the Tentative Agreement for 2005-2008.
